Terms & Conditions

These Terms and Conditions ("Terms") govern your use of thegotoguy.co.za and all of its subdomains and services — the Business Directory, The Gazette, the Job Board, Events and ticketing, Daily Deals, the Property Board, the Service Delivery hub and the related business and organiser portals (together, "the Platform"), operated by The Go-To Guy ("we", "us"). By using the Platform you agree to these Terms. If you do not agree, please do not use the Platform.

1. The Platform

The Go-To Guy is a community platform for the North-West region of South Africa. We publish local news, host directories and listings created by businesses and individuals, facilitate enquiries between visitors and businesses, and sell event tickets on behalf of organisers. Except where we say otherwise, we are a venue: listings, deals, properties, jobs and events are created by the businesses concerned, and any transaction you conclude with a listed business is between you and that business.

2. Accounts and portals

• You must provide accurate information when registering and keep your login details confidential. You are responsible for activity under your account.
• Business portal accounts may only be used for the business they were created for. We may suspend or close accounts that breach these Terms.

3. Paid services and billing

Current fees for business services are:

• Business Directory membership: R250 per month or R2,500 per year.
• Job Board employer subscription: R99 per month. Optional extras: featured listings R199; CV database access R499.
• Daily Deals membership: R149 per month.
• Property Board: R2,499 per month (agency subscription — unlimited listings, up to 10 agents) or R249 once-off per listing.
• Events: first event listing each calendar month free; additional listings R99 each. Ticket sales carry a service fee of 6% of the ticket price plus R1 per ticket, deducted before payout to the organiser.

All fees are in South African Rand and include VAT where applicable. Payments and recurring billing are processed by Paystack. Subscriptions renew monthly (or yearly, where selected) until cancelled. You can cancel from your portal at any time; cancellation stops future billing and your service remains active until the end of the period already paid for. Fees already paid are not refunded for partial periods. We may change fees on reasonable notice; changes take effect from your next billing period.

4. Event tickets

• We sell tickets as agent for the event organiser. The contract for the event itself is between you and the organiser.
• Tickets are delivered by email after successful payment. Check your details carefully before paying.
• If an event is cancelled or materially changed, refunds are the responsibility of the organiser. We will assist with reasonable cooperation, and where we still hold the ticket funds we will process refunds on the organiser's instruction. Our service fee relates to the transaction service and is not refundable except where required by law.
• Nothing in these Terms limits your rights under the Consumer Protection Act, 68 of 2008, where it applies.

5. Listings and business content

• Businesses are solely responsible for the accuracy and lawfulness of their listings, deals, job adverts, events and property listings, including prices, availability and images, and for holding any licences their trade requires.
• Property listings must be genuine and listed with the authority of the owner or mandated agent. Job adverts must be for real vacancies and comply with employment and anti-discrimination law.
• We may review, decline, edit for formatting, or remove any listing or content at our discretion, including content that is unlawful, misleading, offensive or infringes the rights of others.

6. Reviews, enquiries and acceptable use

• Reviews must reflect your genuine experience. Fake, defamatory or paid-for reviews are prohibited and may be removed.
• Enquiry and contact systems may only be used for genuine enquiries to the business concerned. Using them to advertise, spam or harvest contacts is prohibited, and we may block senders who abuse them (including silently discarding their messages) and apply sending limits.
• You may not interfere with the Platform's operation, attempt unauthorised access, scrape content at scale, or use the Platform for anything unlawful.

7. Your content and licence

You keep ownership of content you submit (listings, images, reviews, articles, adverts). You grant us a non-exclusive, royalty-free licence to host, reproduce, adapt for display, publish and promote that content on the Platform and in Platform marketing (for example sharing an article or listing on social media). You warrant that you have the rights to the content you submit and that it does not infringe anyone's rights.

8. Our content

The Platform, its design, branding, logos and the content we create (including Gazette articles written by our team) are our property or licensed to us and are protected by copyright and trade mark law. You may share links to the Platform freely; you may not republish substantial parts of it commercially without our written permission.

9. Advertising

The Platform carries paid promotions (for example featured listings and banner placements) and third-party advertising served by Google AdSense on The Gazette. Advertisers are responsible for their own advertisements. Advertisement of a business on the Platform is not our endorsement of it.

10. Disclaimers

The Platform is provided "as is" and "as available". While we work to keep it accurate and online, we do not warrant that it will be uninterrupted or error-free, or that information in listings and articles is complete or current. News content is provided for general information and is not professional advice. Service Delivery reports reflect reports by members of the public and are not verified statements of fact.

11. Liability

To the extent permitted by law (including the Consumer Protection Act where it applies), our total liability to you arising from the Platform is limited to the greater of the fees you paid us in the three months before the claim arose or R1,000, and we are not liable for indirect or consequential loss, loss of profits, or loss of data. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for gross negligence or wilful misconduct.

12. Indemnity

If you are a business using the Platform, you indemnify us against claims by third parties arising from your listings, your content, your products or services, or your breach of these Terms.

13. Privacy

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

14. General

• These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
• If any provision is unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it.
• We may update these Terms from time to time; the current version, with its effective date, will always be available on the Platform. Continued use after changes take effect constitutes acceptance.
